Where the claims come from

A crew under deadline works through lunch. Payroll deducts 30 minutes anyway. Nobody complains that week. Two years later, a departing employee's lawyer adds up 30 minutes a day, five days a week, across the whole employment period, and sends a demand letter. The employer's defense requires proving lunches happened, and an auto-deduction system has no record of that: the deduction is the same whether lunch was taken or skipped.

The math is the reason these claims get filed. Thirty minutes a day at $26 an hour is $13 a day, about $65 a week, and over $3,000 a year, per worker, before any penalties or doubled damages a state might add.

If you keep auto-deduction

  1. Have a written way for workers to report a missed or interrupted lunch, and pay those reports without friction. Punishing the report is what turns one claim into a class.
  2. Have supervisors confirm lunches actually happen on deadline days, in writing.
  3. Audit a sample month per year: compare deducted lunches to what supervisors and workers say actually happened.
